Commonly Used Terms
The term 'FlagSeller' or 'us' or 'we' refers to the owner of flagseller.co.nz.
The term 'you' refers to the customer of our services.
Return to Base Warranty
Flagseller.co.nz warrants that all flags and accessories manufactured and sold are fully conforming to all product specifications as stated in our offer or catalog. All flags manufactured and sold by flagseller.co.nz are guaranteed to be free of defects in material and workmanship, or they will be repaired or replaced for free (at our discretion). It subjects to the following limitations and exclusions.
Limitations and Exclusions
- Normal wear and tear: all flags flown outdoors are subject to normal wear and tear and the adverse effects of weather and sunlight, although good care and actions by the user can greatly prolong the life of a flag. it is very difficut to offer a specific “flag service life” warranty due to the varied conditions encountered, and the amount of care. A general rule of thumb for the industry is that a standard sized flag should normally have a life expectancy of 6 – 12 months, if flown from dawn until dusk in good weather conditions.
- Damage caused by misuse, neglect, improper installation, unauthorized attempts to modify the product
- Damage caused by accident, fire, water or liquids, power changes, other hazards, or acts of God
- Damage caused by extreme weather, such as: storms, snow, rain, hurricanes, tornados, thunderstorms, micro-bursts, earthquakes, ice storms, tsunamis or any other act of nature
- Damage done to the flag if it is flapping against a roof, building, tree, branches, or if it comes in contact with any other object
Repair and Replacement within Warranty
Photos of damaged flags and/or flags returned for inspection will be thoroughly analyzed by our Flag Specialist to determine the cause of damage, and our course of action. Exclusive Remedies and Procedure FlagSeller’s total obligation under this warranty shall be, at FlagSeller's sole discretion, to repair or replace the product or part with a comparable product or part.
Limitation of Liability
FlagSeller’s liability arising out of or related to this agreement, including without limitation liability for negligence, will not exceed the value of the product and/or order in any condition.
We try our best to match the colours on your artwork. Due to the special UV light heating process in the flag printing, we do not guarantee the exact colour match. You should expect slight colour difference between the flag and the artwork. In most cases, the surface will turn to a slightly darker or reddish. Pantone codes have to be provided if a better matching is required.
Artwork Files for Printing
When sending own designs for printing, you are responsible for following our artwork guidelines. We will preview all incoming files and attempt to find potential problems, but assume no responsibility should your job be printed incorrectly. We presume that the files you send are the files you want printed. Please download design guidelines to see design specifications of each product.
All artworks you submit must use CMYK instead of RGB. We are not responsible for colour shifts because of conversion.
Copyright and Ownership
If supplying your own printable files, you certify that you own the rights to use the image(s) being reproduced by FlagSeller.co.nz. If you scan your own copyrighted materials and ask us to reproduce the same, you still own the rights to use the image(s) being reproduced by FlagSeller.co.nz.
By supplying your own images, text, or any other data to us, you grant us permission to use this material freely in the pursuit of the design. You also agree to fully indemnify and hold us free from harm in any and all claims resulting from you in not having obtained all the required copyright, and/or any other necessary permission.
All materials and artwork created directly by FlagSeller.co.nz, including typesetting, layouts (both online and off-line), etc. are the property of FlagSeller.co.nz.
We reserve the right to display the artwork in our gallery unless otherwise notified in writing. We also reserve the right to send samples of your printing unless otherwise notified in writing. We will not use your images in any advertising without your prior written consent.
You may request in writing from us, the necessary permission to use materials (for which we holds the copyright) in forms other than for which it was originally supplied, and we may, at its discretion, grant this. Such permission must be obtained in writing before it will allow any of the aforesaid artwork, images, text, or other data to be used.
Once you place your order, there is no cancellation. You have committed to ordering the product and paying for it. Please understand that custom printing is not something we can put back on our shelves where someone else will come along and buy it.
You must notify us in writing within five working days of receiving your order that there is a problem with your product. Please take a photo of the issue and email it to us outlining the issue(s).
Reprints are provided on a case-by-case basis. We DO NOT provide refunds.
In no case FlagSeller.co.nz is liable for loss of your business or implied damages because of our products.
Turnaround & Shipping
Turnaround time-also known as production turnaround time-varies by product, ranging from 2 to 8 working days. The estimated turnaround time of each product can be found in the product description, which is not guaranteed.
Delivery times are estimated based on the information provided to FlagSeller.co.nz by the carrier and in no way we should be responsible for delays in arrival time. We will notify you of any potential problems caused by the carrier.
We collects Your personal information so that we can provide You with the Service and any related services You may request. In doing so, Xero may use the personal information we have collected from You for purposes related to the Services including to:
- verify Your identity,
- administer the Service,
- notify You of new or changed services offered in relation to the Service,
- carry out marketing or training relating to the Service,
- assist with the resolution of technical support issues or other issues relating to the Service,
- comply with laws and regulations in applicable jurisdictions, and
- communicate with You.
By using the Service, You consent to Your personal information being collected, held and used in this way and for any other use You authorise. We will only use Your personal information for the purposes described in this Policy or with Your express permission.
If You choose to pay for the Service by credit card, Your credit card details are not stored by us. Your credit card details are encrypted and securely stored by Paypal to enable us to bill your credit card.
